Implementing a UDRP Decision

When EnCirca is notified that there is a pending UDRP proceeding, the disputed domain is moved into a Hold account.

Once a decision has been reached by a UDRP panel, it will be communicated by the UDRP provider to each Party, the concerned Registrar(s), and ICANN. EnCirca will then communicate to each Party, the Provider, and ICANN the “implementation plan” for the decision in accordance with the Policy.

  • If the UDRP was decided in favor of the current registrant, then the domain is moved back into the registrant’s account after 10 days
  • If the UDRP was decided in favor of the complainant, then the domain is moved into an EnCirca user account created by the new owner, no sooner than 10 days after the decision is communicated to EnCirca.

The typical process is as follows:

  • EnCirca is notified of a UDRP decision by the UDRP Provider.
  • EnCirca issues a “UDRP Decision Implementation” email to all concerned parties, explaining the next steps following a 10 day waiting period.
  • If the UDRP was decided in favor of the current registrant (“Respondant”), then the domain will be moved from the Hold account back to the Registrant’s account
  • If the UDRP was decided in favor of the Complainant, then the domain will be moved from the Hold account to an EnCirca user account specified by the Complainant.
  • The domain name will not be moved until the Complainant specifies the EnCirca User Account they wish the domain to be moved to.
  • Once the domain is moved, then the Complainant is then responsible for updating the Whois information and nameservers for the domain name.
